Challenging Cases: Thinking Outside of the Box

    speaker headshot Kim Elia
    In-person Presentation

    Kim Elia

Kim Elia was inspired to study homeopathy when he read Gandhi’s quote about homeopathy, “Homeopathy cures a greater percentage of cases than any other method of treatment. Homeopathy is the latest and refined method of treating patients economically and non-violently.” He has been studying homeopathy since 1987 and graduated from the New England School of Homeopathy.

Kim was in clinical practice with Dr. Paul Herscu, author of The Homeopathic Treatment of Children, Pediatric Constitutional Types. Kim is the former Director of Nutrition at Heartwood Institute, California, and has certified many nutritionists across the state of California. During that same time, he was the Director of Fasting at Heartwood, and worked with fasting therapeutics with many hundreds of people.

Kim serves as CEO of WholeHealthNow. He has been instrumental in the creation of WholeHealthNow’s website, a comprehensive free informational resource for students and professionals. He was inspired to create the Historic Homeopathic Timeline, and is responsible for a growing library of recorded interviews and presentations with today’s world renowned homeopaths on a variety of timely and relevant topics. Kim’s intent is to bring the homeopathic community together and to contribute to the training of effective practitioners who will bring homeopathic medicine forward into the mainstream.

Students from around the world have expressed appreciation and admiration for Kim’s superb knowledge of the history of homeopathy, his deep understanding of homeopathic prescribing, and his extensive knowledge of materia medica. He is known for his dynamic and distinctive teaching methods which reflect his immense knowledge of the remedies and his genuine desire to educate everyone about this affordable and effective healing modality. Kim was the principal instructor and developer of the four year classical homeopathy program at the Hahnemann Academy in Tokyo and Osaka, Japan. He is currently developing new homeopathy projects.

In-Person: During this presentation Kim will review a number of challenging cases that required using approaches outside of the ‘normal repertorization’ and ‘look-up-the-remedies in the materia medica’ process. Even though each of these examples does not follow a more orthodox approach, Kim will demonstrate from the literature that these approaches fall within the scope of homeopathic practice.

Powerful Healers: Examining some of the conundrums surrounding the Schuessler Cell Salts

speaker headshot Miranda Castro, CCH, RSHom(NA), FSHom
    Livestream Virtual Presentation

    Miranda Castro, CCH, RSHom(NA), FSHom

A professional homeopath since 1982, and international teacher of homeopathy since 1988. Miranda has authored three popular homeopathic books “The Complete Homeopathy Handbook”, “Homeopathy for Pregnancy, Birth and Your Baby’s First years”, and “A Homeopathic Guide to Stress”. She is a regular contributor to both professional homeopathic journals and popular publications dealing with complementary health matters and homeopathy. She taught at Bastyr Naturopathic University (1995-2000) and has been very involved in the growth and development of the North American Society of Homeopaths, having served as both Executive director (1996-98) and President (1998-2000). She consulted on, and written numerous articles for Homeopathy Today (the magazine of the National Center for Homeopathy) for 25 years.

Miranda believes passionately that homeopathy is ‘medicine for the people’ and her writing reflects that: her books have made classical homeopathy spectacularly accessible to the lay person – giving people the tools to accurately and safely select healing remedies for themselves and their families. She is an engaging and inspiring lecturer and her infectious enthusiasm and her ability to communicate difficult topics in a friendly, engaging and accessible manner come through in all her articles, lectures, tapes/DVDs … and webinars. She moved to the US in 1994 and has been living in Gainesville Florida since 2006 where she is practicing, writing, teaching, developing healing creams, homeopathic software—and planting an edible, sub-tropical garden!

Vitual: In this presentation Miranda will explore the Schuessler Cell Salts from a classical homeopath’s perspective giving pointers for home prescribers and practitioners alike. Her presentation will be packed with information and food for thought. It will be peppered with cases from her own practice and patients’/students’ home prescribing to illustrate the breadth and depth of this lovely range of remedies when they are carefully selected based on a larger picture than one or two physical symptoms.

Alastair has been in practice for more than 30 years.

In-Person: In this presentation and workshop Alastair Gray will guide participants through the broad landscape of research in homeopathy. Alastair will explore why the emphasis on mechanism of action in homeopathy research, and clinical research, while interesting, has drawn the oxygen from the immediate needs to the profession – which is to contribute to urgent public health and health services research outcomes. Homeopathy desperately needs to build research capacity. Practitioners can assist. With this emphasis on generating meaningful research skills as part of an overarching strategy the next steps in the path includes this necessary upskilling of practitioners. In this presentation Alastair describes how the practically orientated research component of the program at the Academy of Homeopathy Education and the emphasis on research embedded within the clinical training portion of HOHM foundation, is able to engage students (future practitioners) in this critically important work to build capacity. In this practical and hands on session participants will learn that with a small time commitment, and with some attention to sound method that daily clinical practice is able to generate the publishable peer reviewed, published practice based outcomes homeopathy as a profession desperately needs. Demonstrations of outcomes from HOHM Foundation’s Homeopathy Health Network – which has seen over 2500 acute cases in the last two years will be peppered throughout this presentation.

Pavlovian Model of Health and Disease in Homeopathy: The Leap to the Similimum

    speaker headshot Divya Chhabra, MD(Hom)
    Livestream Virtual Presentation

    Divya Chhabra, MD(Hom)

Born in Pune in 1967, she was introduced to homeopathy at the age of 7 months, when a severe colic, was instantly relieved and a looming laparotomy averted.

After graduating as a Gold Medallist from CMP homoeopathic medical college, she did her MD from DKMM Homoeopathic Medical College. She did her residency at Mumbadevi hospital and at Bhatia hospital where she gained ICU experience as well. Two diagnostic skills were honed, in parallel. Homeopathic State and Similimum diagnosis and Pathological Disease diagnosis.

Her ever questioning mind asked, “1 pill of a 30 potency. Really?” To experience the effect of this one pill of the homeopathic remedy, she began Proving remedies.10 new homeopathic remedies have been researched, which are being used all over the world today.

Her unwavering dedication to her patients, the search for the ‘bull’s eye’ similimum (the perfect constitutional homeopathic remedy for the patient) is matched by her zeal for teaching all that she knows to the practitioners and students of homeopathy. To this end she has since the last 26 years been teaching homeopathy in India and around the world.

Her evolving methodology in the quest for perfection has one constant; the exploration of the unconscious (Automatic Neurological Circuits) as a controller of disease patterns. This has led her to delve deep into the understanding of neuroscience, physiology and disease origin.

The result, the pinnacle of her work is the “Leap to the Similimum” method she practices today.

Virtual: Paramita (excellence -Sanskrit), Sante (health-French), Bahav (The Flow state-Urdu) allow us to reach our full potential, our higher purpose of being. It needs the ‘inside’ and the ‘outside’ to be one.

The ‘invisible strings’ of the state that hold one back, are Pavlovian conditioned Patterns, which then act as a biological switch, facilitating gene expression of disease (Epigenetics).

The “Leap to the Similimum-neuroscience model” makes these strings ‘visible’ and changes the faulty patterns both in ‘behavior ’and ‘body functioning’.

This is Dr. Divya’s latest, Leap into the Unconscious. It happened to her. She will make it happen for you at JAHC 2022.

Homeopathic Treatment of Autism Spectrum Disorders

speaker headshot Jamie Oskin, ND, DHANP
    In-person Presentation

    Jamie Oskin, ND, DHANP

Jamie Oskin, ND, DHANP is a highly trained naturopathic physician with an expertise in homœopathy and natural pediatrics. Dr. Oskin was inspired to study the Bönninghausen repertory after hearing George Dimitriadis speak at the JAHC in Virginia in April 2013. He has been using TBR2 almost exclusively in clinical practice since then. Dr. Oskin is nationally regarded for his use of the Bönninghausen Therapeutic Pocketbook and has published the following articles. Dr. Oskin taught a 13 hour course introducing the TBR2 repertory method for WholeHealthNow. He also was one of the lecturers for the HANP Core Curriculum Course available through Whole Health Now.

While he treats a wide variety of chronic and acute conditions he is especially passionate about helping children. Dr. Oskin credits his passion for pediatrics to his early cases as a resident. He recalls helping several children with chronic recurrent ear infections that resolved completely with homœopathic treatment. “Helping those kiddos inspired me to focus my practice in pediatrics because it was so much fun to help them get healthy. I love seeing kids flourish so they can live up to their fullest potential!” Witnessing a child’s transformation is especially rewarding for Dr. Oskin because of the huge impact it has on his patients’ families. Dr. Oskin is nationally regarded for his expertise in helping families with child developmental disorders including Autism, Asperger’s, ADD/ADHD, PANDAS, Sensory Processing Disorder, and tic disorders.

Dr. Oskin has a history of achievement in his field. After graduating with High Honors from the Southwest College of Naturopathic Medicine (SCNM) in Tempe, Arizona, Dr. Oskin completed a one-year residency in a general family practice and then a second-year specialty residency with a focus in homœopathy at the Southwest Naturopathic Medical Center in Scottsdale, Arizona under the supervision of internationally renown homœopath, Stephen Messer, ND, DHANP. Dr. Oskin is a national speaker on the homœopathic treatment of ADHD and Autism, and his work has been published in Homeopathy Today, the American Journal of Homeopathic Medicine, Naturopathic Doctor News and Review, Simillimum, and Chiropractic Economics. Additionally, Dr. Oskin plays an active role in education as a guest lecturer and was a former adjunct faculty member in the homœopathy department at SCNM. Dr. Oskin is the current president of the HANP (Homœopathic Academy of Naturopathic Physicians).

In-Person: Dr. Oskin will provide an introduction to the homœopathic treatment and management of Autism Spectrum Disorders. A series of case examples will be presented utilizing primary text sources including the TBR2 (The Bœnninghausen Repertory, Second Edition) and Hahnemann’s materia medicæ. Attendees will be exposed to case examples including characteristic symptoms in each case as well as selecting the most indicated homœopathic medicine in each case from the materia medicæ. In addition, the case examples will serve as teaching guides for the management of these complex cases including when to change the posology and/or when to change the homœopathic prescription. At the end of the presentation, participants will be better equipped to treat ASD cases in clinical practice.

Pharmaceuticals and Homeopathy: A case centered examination of the issues, approaches and strategies in treating patients on pharmaceuticals, homeopathically

speaker headshot John D. Millar, BSc, ND, DHANP, CCH, Hom
    Livestream Virtual Presentation

John D. Millar, BSc, ND, DHANP, CCH, Hom

John Millar received his Bachelors in Experimental Psychology from Trent University in 1978. After a few years as a teacher and musician, he attended one year of pre-med studies at the University of Waterloo and then on to OCNM where he graduated in 1988 with a Doctor of Naturopathic Medicine. From that point forward, he has studied homoeopathy throughout the world with the likes of Andre Saine, Jeremy Sherr, Vassilis Gehgas, Rajan Sankaran and others, receiving his DHANP in 1999.

He has taught extensively, including 12 years as a clinical supervisor at CCNM and nine years at OCHM. He has been on staff at the Canadian College of Homeopathy and the American Medical College of Homoeopathy. In addition, he has taught and been a keynote speaker in his involvement with Homeopaths Without Borders (HWB) in Cuba, Guatemala, Honduras and El Salvador. He has sat on the Board of the Homeopathic Academy of Naturopathic Physicians, the Council on Homeopathic Education, and Homeopaths Without Boarders, where he was also the Executive Director of the North American branch and former President of the Canadian branch. From 2009-2014 he sat as a member of the Transitional Council of the College of Homeopaths of Ontario. In the past few years Dr Millar has been involved with developing core curriculum in homeopathy and acts as a consultant to educational institutions, as well as continuing to present webinars on various topics in homeopathy.

Virtual: Dr. Millar will present a series of short cases treated concurrently with homeopathics and pharmaceuticals. The purpose of this presentation is to reflect upon the issues, approaches and strategies that arise in treating such cases. In some instances the homeopathic acts curatively and the pharmaceutic is ultimately removed and in others only palliation can be achieved. It will be demonstrated how pharmaceuticals generally slow down and inhibit the action of the homeopathic and how the homeopathic dosing needs to be adjusted to be more aggressive. Conversely a well selected remedy will reduce the underlying dynamic disturbance and the pharmaceutical will act more efficiently, side effects will manifest and the pharmaceutical dose will need to reduced. Further, we will see how in some cases the pharmaceutical is not well tolerated and the homeopathic dose of the same works well. In other cases presented, we can observe how the pharmaceutical acts as an obstacle to cure, but we can still successfully palliate and improve the patient’s quality of life. Many cases that come to see the homeopath, particularly in developed countries, are on pharmaceutical medications, some on many. It is Dr. Millar’s hope that this presentation will provide some strategies for the attendees to help them resolve these most difficult cases.

Denise maintains a busy practice in classical homeopathy with a focus on complex neurological and autoimmune conditions and provides clinical supervision and mentorship to students and professional homeopaths around the world.

In-Person: How is it that Homeopathy, the second most widely used medicine in the world today—with more than 200 years of clinical experience—has yet to agree on a set of guidelines as to what we do and how we do it? Perhaps it is because we have yet to fully understand the ways in which Hahnemann came to develop this amazing system of medicine, and its therapeutic interventions. This presentation explores the stated historiography of Homeopathy and, by way of previously unexplored primary source materials, proposes a revised narrative–full of twists and turns, pseudonyms, and missing footnotes—on the way towards elucidation of a more complete and understanding of Hahnemann’s genius.

Denise Straiges will be holding a q&a in the next day or two post conference. Please email dstraiges@ahe.online to get information on day and time, and to be sent the replay if you cannot attend! She will be recording.

Arup is a registered full member of the College of Homeopaths in Ontario. He has a BSc in Microbiology, a MSc in Biophysics and MA in Psychology. He has a PhD in Molecular and Cellular Biophysics from SUNY at Buffalo, NY. He contributes articles regularly in peer reviewed journals such as in Nature Communications, Science Translational Medicine, EBioMedicine, Clinical Cancer Research and others.

In-Person: The body acts as an emotional sink absorbing emotional perturbance brought about by ever changing life situations in an individual. These constricting emotions trigger various pathways in the body causing long term stress, local spasms and hypoxia which can and does often lead to chronic and auto-immune illness. Properly selected homeopathic remedies can unravel the trapped emotions in the mind-body continuum, relieving the psychosomatic pain and suffering. Dr. Bhattachara uses this strategy in his cases, where apt, and, has successfully reversed chronic pain and illness that he will elucidate in his presentation using examples form his practice. The power of homeopathy as a nanomedicine in shifting the balance and in regaining health can significantly impact patient quality of life.

    The Bönninghausen Repertory in Praxis

    Prerecorded Presentation

    George Dimitriadis, BSc(UNSW), DHom(Syd), DHomMCC(Eng), FHom(UK), GHIH(Syd), FJPHMA (Jpn)

George Dimitriadis had his introduction to Homœopathy nearly forty years ago, when a friend showed him how ‘potentisation’ actually made highly diluted substances ‘stronger’ and more effective. This idea aroused George’s curiosity and George commenced his own study of Homœopathy (1979-1982), then medical sciences (1983-1986), graduating from the University of New South Wales before taking up full-time homœopathic practice in Sydney (1986).

George travelled widely through Europe and India, visiting clinics and teaching institutions in order to observe first-hand their method of learning and of application. He has taught both within Australia and internationally, contributed numerous articles to a number of professional journals, and authored six books for the profession. George was founding Vice-President and later President, Society of Classical Homœopathy (SCH, 1985-1995), also Chief Editor, Australian Journal of Homœopathic Medicine during its publication life (1992-95), and founder (1993) of the Hahnemann Institute (Sydney). From 1995 George began to focus on the work of Bönninghausen and in particular his Therapeutic Pocketbook, and spent the next 5 years on his English language TT re-publication project, culminating with the publication of The Bönninghausen Repertory (TBR, 2000). The second edition TBR2 (2010) is widely recognised as the most reliable repertory available today.

George and his wife Jacqualine practice at the Hahnemann Homœopathic Medicine Centre, located in Sydney.

Pre-Recorded: This presentation will present a number of cases to illustrate the application of Bönninghausen’s final and most perfected model of repertory, Therapeutisches Taschenbuch (TT), through our own modern English re-translation of The Bönninghausen Repertory (2nd edition, TBR2). A prerecorded video presentation streamed In-person and online.

Mapping the Mind in Psychiatry Cases

speaker headshot Anita Salunkhe, MD(Hom), DHMS
    Prerecorded Presentation

    Anita Salunkhe, MD(Hom), DHMS

Dr. Anita Salunkkhe is an internationally acclaimed homeopath, who specializes in pathological and incurable cases. She is also known for her incredible success with psychiatric patients and treating mental health issues.‍

Dr. Salunke is known for her Eight Step Method, a revolutionary diagnostic tool that she has developed. She has been teaching it at workshops and seminars for more than three decades. Her thorough Case Taking and concept of Key Sensitivity are cornerstones of her approach to treatment.

Her decade-long association with Dr. Rajan Sankaran laid the foundation for her in-depth understanding of Case Taking, while under the mentorship of Dr. Praful Vijayakar, founder of the Predictive School of Homeopathy, Dr. Salunke received a foundation in the Theory of Suppression and an understanding of Miasms. It was also Dr Vijaykar’s study of the human Genetic Constitution that set her on the path to treating incurable and pathological cases.

Dr. Salunke has mastered the art of assessing Miasms, which has contributed to her remarkable success. Also, due to her early grounding in Psychiatry (she holds a Doctor of Medicine degree in Psychiatry), she is a specialist in treating psychiatric cases with homeopathy.

She is a world-class educator and has been teaching her revolutionary approach to homeopathy at seminars and workshops in India and around the world.

Pre-Recorded: Dr. Salunkkhe blends the scientific knowledge of the classical masters with newer systems evolved by contemporary stalwarts, to arrive at a highly refined approach to Case Taking. At the heart of this approach is a synthesis of homeopathy as a science and of Case Taking as an art. Dr. Salunkkhe demonstrates this syncretic approach while always keeping the highly individualized patient as the focus. The objective is one hundred per cent accuracy. Highlights of this presentation: • Individuation – Dr. Mahesh Gandhi has proposed that each case reflects the individuation of the patient. It is this individuation that makes each person different from the other and it is this individuation that expresses itself in the disease patterns they develop. • PEM & Inner Age – The Personal Evolution Model or PEM maps the ‘inner age’ of the patient. This is the developmental age at which the patient is stuck and it usually does not correspond with their chronological age. Dr Gandhi’s concept of inner age was founded on the eight stages of Psychosocial Development of German-American psychologist Erik Erikson. • Key Sensitivity – Each one of us has that one key issue around which we script our life story. This Key Sensitivity – the issue that the patient is most sensitive to – governs the individual throughout their life and is at the root of their disease. It is a concept I developed and refined through years of practice. By discovering the patient’s Key Sensitivity, and along with the PEM model, the practitioner can easily arrive at the root of the patient’s disturbance. After understanding the patient’s life script and inner age, the practitioner must analyze the information using classical scientific models and charts, and classify the patient as animal, mineral or plant. The practitioner must also use Jan Scholten’s Periodic Table, Dr. Michal Yakir’s Two-Dimensional Plant Chart and Dr Mahesh Gandhi’s Animal Chart. These charts will help map the patient in order to arrive at the similimum. The wise homeopath uses an eclectic approach and always balances its scientific aspects against its artistic potential. I received my scientific foundation from Dr Praful Vijayakar, and his Chart of Suppression, understanding of miasm and Genetic Constitution is the bedrock of my practice. On the artistic side, I learnt the Kingdom Theory and its application from Dr. Rajan Sankaran and the PEM Model from Dr. Mahesh Gandhi. These approaches play to the intuitive strength of the practitioner. While critics may argue that the multiplicity of approaches could distract the practitioner from what they are supposed to see, this is not how it works. Patients present many different pictures – some offer complete symptoms (location, sensation, modalities), while others offer only their life stories, giving the practitioner much less to work with. Using an amalgamation of approaches – which while different from each other also complement each other – increases the probability of arriving at the similimum with minimum distractions! It is Case Taking at its sophisticated best.

●State Strategies to Support Family Caregivers

State Strategies to Support Family Caregivers

This session builds on the organizing principle that the family is the basic unit of society – and that society, in turn, must recognize and support family caregivers. The federal government has recognized this critical role of caregivers through its RAISE Family Caregivers Advisory Council, through the National Family Caregiver Support Program, the VA Caregiver Support Program, and through the use of Medicaid’s home- and community-based services waivers to provide self-directed care through a family caregiver. The global community has begun to recognize the role of caregivers, with global convenings by the World Dementia Council, the Global Coalition on Aging, and the International Alliance of Carer Organizations, among others. Now is the perfect opportunity for individual states to take leadership – within the ecosystem of federal and global efforts – to continue to build momentum for caregiver supports. We believe that caregiving is core to the nation’s public health, and that states can learn from each other how best to support the diverse and dynamic population of more than 53 million family caregivers of people across the lifespan.

Michael R. Wittke, National Alliance for Caregiving

Michael R. Wittke, National Alliance for Caregiving

    Breakout Session II

●The Relationship Between Mental Illness and Intimate Partner Violence and Abuse (IPV/A) in Dementia-Related Intimate Partner Homicides and Suicides

The Relationship Between Mental Illness and Intimate Partner Violence and Abuse (IPV/A) in Dementia-Related Intimate Partner Homicides and Suicides

The marked increase in life expectancy over the last century, especially in richer countries, means growing numbers of people will develop dementia. The OECD estimates that by 2030 the number of dementia cases will increase by 50 percent in rich countries and 80 percent in poorer ones.

Considerable research attests to the violence and abuse directed at people suffering from dementia. Much less research documents the commission of severe violence and abuse by people with dementia. This session reports findings from eleven publicly available UK domestic homicide reviews in which husbands suffering from dementia killed their wives. In three of the eleven cases the perpetrator committed suicide in the immediate aftermath of the homicide. In one case, he took his own life three months later. Using these detailed case studies, Dr. Websdale reports baseline qualitative data on the complex relationships among histories of intimate partner violence and abuse (IPV/A), mental illness, and dementia. The aim is to describe the micro-dynamics of dementia cases culminating in homicide where IPV/A and mental illness co-occurred or were suspected of co-occurring. It is hoped such baseline knowledge will inform service delivery and the development of experimental and quasi-experimental studies that might improve risk assessment and management.

Dr. Websdale has written five books: Rural Woman Battering and the Justice System: An Ethnography (Sage, 1998) which won the Academy of Criminal Justice Sciences Outstanding Book Award in 1999; Understanding Domestic Homicide (Northeastern University Press, 1999); Making Trouble: Cultural Constructions of Crime, Deviance, and Control (Aldine Books, co-edited with Jeff Ferrell, 1999); Policing the Poor: From Slave Plantation to Public Housing (Northeastern University Press, 2001), winner of the Academy of Criminal Justice Sciences Outstanding Book Award in 2002 and the Gustavus-Myers Center for the Study of Bigotry and Human Rights Award in 2002; Familicidal Hearts: The Emotional Styles of 211 Killers (Oxford University Press, 2010). Dr. Websdale’s social policy work involves helping establish networks of domestic violence fatality review teams across the United States and elsewhere. He also directs various community informed intimate partner violence risk assessment initiatives, the fatality review and safety assessment projects, and a number of other multiagency and interdisciplinary initiatives. Dr. Websdale trained as a sociologist at the University of London, England and lives and works in Flagstaff, Arizona

Theft of Money, Jewelry, and Opioid Pain Medications from Residents in Assisted Living Residences in Minnesota: An Exploratory Study

Financial exploitation and thefts of opioid pain medications from residents is a prevalent and harmful form of elder mistreatment in long-term care homes. Only limited focus has been dedicated to these crimes in assisted living residences, a sector that is fast-growing but weakly regulated in many states. Part 1: Based on an examination of Minnesota Department of Health's (MDH) investigation reports substantiated as financial exploitation, this exploratory study identified the types of personal items stolen from residents, their monetary and personal value, the ways in which the thefts were identified including the extent to which they were caught on a surveillance camera. Part 2: Based on an examination of MDH's investigation reports substantiated as "drug diversion," this exploratory study identified the number of residents from whom opioid pain medications were stolen, the number of medications stolen, the techniques used by perpetrators to steal the medications, and the ways in which the thefts were identified including the extent to which they were caught on a surveillance camera. The preliminary findings can be used to inform prevention efforts and future research.

According to SAGE, as many as 60% of LGBTQI+ elders worry about how they will be treated in long-term care facilities, and many feel safer not disclosing their sexual identity or gender. Lived experiences with stigma and discrimination contribute to unique vulnerabilities and reluctance to access care.

In Visibility Matters attendees will learn some of the historic events that shaped attitudes and interactions with our institutions, and gain some of the tools needed to create a safe place for LGBTQI+ people to be their authentic selves and receive the support they deserve to age with dignity and respect.

●Navigating the Patchwork: Civil Rights for Older Adults

Navigating the Patchwork: Civil Rights for Older Adults

Access to justice is a critical component of the Rule of Law, a concept that appears under attack around the world on an almost daily basis, according to media reports. While Rule of Law encompasses the entire structure and processes of government, access to justice is the individual empowerment and enforcement component of the Rule of Law that depends upon individuals’ knowledge of their rights and access to tools to enforce those rights effectively and affordably. Access to justice is critical in achieving equity for older adults, and the absence of it perpetuates disparities, while making the case for racial justice—spurred by last year’s protests for Black Lives Matter—even more apparent. In the absence of access to justice, people of all ages in our society are unable to have their voices heard, to exercise their rights, to remedy violations, to challenge discrimination and to hold decision-makers accountable.

Access to justice for older people and their families in the United States has been a mixed bag of successes and failures, exacerbated by the COVID-19 pandemic.
